Pinal County Minor Land Division ordinance.


Requires application, review and approval of all parcel splits resulting in parcels less than 40 acres. The logical process of the MLD is to first review you desires with the County Planning and Development office. If they see a problem with your desired configuration that can be addressed before you invest in the survey and application. You are allowed ONLY 5 new parcels to be created from any existing parcel. You must also meet minimum lot area requirements, and setbacks for the zoning.

Once you have established the parcel splits are going to meet the County and State requirements please contact the various utilities serving the property (water, electric, phone etc.) and determine if there will be fees for extending the services to each parcel, and consider their input on the best configuration to acquire service. Planning can make the difference between a costly lesson and a profitable endeavor.

Once you are set on configuration you should obtain a copy of the legal description for your property from the County Recorder. You may have copies of the recorded description in your title policy from your purchase of the property. Again please do not rely on the description cited on your Assessors tax bill. These are frequently abbreviated, inaccurate and missing important information. The recorded deed in the Recorders office is the only reliable source.

Once you supply your surveyor with a parcel split configuration and description for the property to be divided, he can proceed with the surveyors portion of the MLD process. We will:
1.    Complete a proper boundary survey of the property to be split
2.    establish all new lot dimensions
3.    establish easements for access and utilities
4.    set the corners of all parcels
5.    create a plat (to county MLD / Record of Survey requirements)
6.    create descriptions for the new parcels
7.    complete the 'surveyors' portion of the application.
8.    and upon approval will create a mylar drawing for recordation in the County records

As you can see there is a considerable amount of work to be completed before your application is ever submitted to the County for approval.
 

Cost of a MLD

As with all surveys, many factors affect the end cost. The least of which is the number of parcels. Whether you are creating one new parcel or five, the process and amount of work is nearly the same. The cost of the initial boundary survey is much more a significant factor. Frequently it is less expensive to survey 40 acres than it is to survey 5 acres. (Please see "areas of service" for a more detailed explanation). Through our office Minor Land Divisions generally range in the neighborhood of $1000 to $2500 PLUS the cost of the initial boundary survey.

Pinal County requires a $560 non-refundable application fee to submit the MLD application, This fee is not included in the surveyors fees, nor is recording fees after final approval.
